Who enforces the Absolute Order?

Under the PERA Force Laws, once a Hearing Officer (HO) issues an Absolute Order, it becomes a final and binding directive that must be executed without delay. However, the enforcement process is not carried out arbitrarily—it follows a structured chain of command to maintain transparency and legal compliance.

The law specifically assigns the Enforcement Officer (EO) the duty to enforce the Absolute Order, but only under the direction of the Sub Divisional Enforcement Officer (SDEO). This means the EO cannot act independently; the SDEO supervises, monitors, and directs the enforcement process to ensure that every action taken is within the legal framework of the PERA Force Laws.

The EO’s role includes executing the physical aspects of enforcement—such as sealing premises, removing nuisances, confiscating goods, or implementing corrective measures as outlined in the Absolute Order. The SDEO’s oversight ensures that the enforcement is neither excessive nor negligent and that it aligns with the specific instructions contained in the Hearing Officer’s decision.

This division of responsibility between the Hearing Officer (decision-making) and the SDEO with EO (execution) upholds principles of administrative justice and accountability. It ensures that every enforcement step is traceable and justifiable under the law.

The PERA Force Laws emphasize procedural integrity at every stage—right from issuing an EPO, converting it into an Absolute Order, and finally enforcing it. The EO and SDEO’s coordinated action under this section ensures that enforcement remains lawful, systematic, and in the public interest.
