What is an Absolute Order?

In the context of the PERA Force Laws, an Absolute Order represents the culmination of the enforcement and adjudication process. It is the final order issued by a Hearing Officer (HO) after evaluating an Environmental Protection Order (EPO) and the evidence presented by both the Enforcement Officer and the accused party.

An Absolute Order includes three essential components:

   Reasons for the decision – The Hearing Officer provides written justification explaining why the order is necessary.

   Directions to the offender – The order outlines the specific actions the offender must take, such as removal of the nuisance, restoration of the environment, or cessation of harmful activity.

Unlike an EPO, which is a preliminary enforcement step that may still be reviewed or contested, an Absolute Order is final, binding, and immediately enforceable. It reflects that due process has been followed, evidence reviewed, and the decision upheld under the provisions of the PERA Force Laws.

The issuance of an Absolute Order ensures that the enforcement process is both legally sound and transparent, providing clarity to all parties involved.
